Despite the outside temperature being around 20°C, experts determined that the interior of the vehicle would have reached over 40°C within just half an hour. Witnesses described seeing Lucky in distress, panting so hard that the vehicle was shaking, until she ultimately became unresponsive. This shocking neglect led to her painful demise.

Folkins was later charged and pleaded guilty to animal abuse, receiving an 18-month conditional sentence and a lifetime ban on pet ownership. While some may consider this punishment fitting, it raises serious concerns about the adequacy of consequences for acts of cruelty. The agreed statement of facts noted that Lucky suffered immensely until her death, which poses the question: is an 18-month at-home sentence truly sufficient for such a preventable tragedy?
