Commend State for Upholding Foie Gras Ban

Target: U.S. Court of Appeals

Goal: Commend the U.S. Court of Appeals for upholding the ban on the sale of inhumanely produced foie gras, otherwise known as duck liver.

Foie gras, or duck liver, is a delicacy most commonly produced through an unethical practice of shoving feeding tubes down the throats of ducks, and forcing them to consume more food than they would naturally. The process is known as gavaging, and the feed foie gras producers use is normally corn, boiled with fat. We should take the time to commend the state of California and the U. S. Court of Appeals for standing their ground against this unnecessary animal cruelty.

Back in 2004, the state of California had enacted a ban on the cruel foie gras production method, and banned the sale of any product produced in this way. A seven-year-long ‘phase-in’ period was implemented  to encourage foie gras producers to experiment and find cruelty-free alternative methods. Instead of searching for a better way to get the product they wanted, the major foie gras producers simply waited for the phase-in period to end. Once the law was enacted, the producers then sued the state. Once the lawsuit was defeated in the general court, those against the ban appealed the decision, and the case was then appointed to the U.S. Court of Appeals. There, the ruling was affirmed, and the attempt to eliminate the ban was squashed. In light of the cruel process being revealed and portrayed over recent years, several large grocery retailers such as Target, Safeway, and Costco, have refused to sell foie gras.

By signing the petition below, you will be showing your support for the state of California and the U.S. Court of Appeals, as well as everyone else who supported the law. While produced using a method that has been used for centuries, the delicacy is not worth the unethical and inhumane treatment of birds. If these animals are to be slaughtered and eaten, they deserve to live a pain-free life, and not subject to forced feeding.


Dear U.S. Court of Appeals,

I am writing to you today to commend you for your actions in protecting against the cruel treatment of ducks. Back in 2004, California state enacted a ban on the sale of any products produced by means of force feeding. The most popular item being the delicacy known as foie gras, or duck liver. The cruel conditions these ducks have to endure before they are slaughtered is unacceptable.

To obtain the buttery consistency foie gras consumers demand, metal feeding tubes are shoved down the throats of ducks, and they are forcibly overfed corn. These ducks deserve to live a plentiful and pain-free life before ending up on a cutting table. This cruel treatment of these birds cannot go on. I would like to take the time to commend your efforts in protecting these animals from experiencing these conditions.
